Fine up to Rs 10 lakh
In fact, it has also been revealed in the possible rules that if someone enters the country through a fake passport or fake travel documents, he can be sentenced to a minimum of two years and a maximum of seven years.
Also, a fine of Rs 1 lakh to 10 lakh can be imposed. According to a report by the Times of India, under this bill, four old laws will be repealed to control matters related to immigration and foreign citizens in India.
What are the rules now?
These include the Foreigners Act, 1946; Passpo Act, 1920; Registration of Foreigners Act, 1939; and Immigration Act, 2000. This new law will combine all of these to create a comprehensive and effective legal system.
Currently, there is a provision of a maximum of five years imprisonment and fine for foreign nationals entering India without a valid passport or visa, while for those entering with fake documents, there is a maximum of eight years imprisonment and a fine of up to Rs 50,000.
What if he stays even after his visa expires?
The new law also has strict provisions regarding foreign students. Under this, all higher education institutions, universities, hospitals and nursing homes will have to provide information about foreign nationals to the government.
According to the report, the new bill also has a provision that if a foreign national stays in India even after the expiry of his visa or enters any restricted area, he can be punished with a jail term of up to three years or a fine of up to Rs 3 lakh or both.
Illegal movement will be curbed
Apart from this, if any illegal foreign national is brought to India through an aircraft or other means of transport, a fine of up to Rs 5 lakh can be imposed on the concerned carrier.
Under this law, the government will get special rights to control the entry of foreign nationals, their activities in India and their exit from the country.
Under this, the government will have the right to ban the movement of any foreigner in India, stop him from going to a particular area and, if necessary, force to take his photograph and biometric information.
Experts say that only an analysis of such laws will reveal the intention behind them. However, such laws cannot be called an answer to anyone. These may be necessary for the sovereignty of any country.
